OpenAI Faces Data Protection Challenge in Italy
OpenAI has received notice from Italy’s data protection authority, Garante, stating that its ChatGPT AI chatbot application violates data protection regulations. Garante, known for actively assessing AI platform compliance with EU data privacy rules, had previously banned ChatGPT due to alleged privacy breaches.
The service was later reinstated after addressed concerns, allowing users to refuse consent for personal data usage in algorithm training. Despite the reactivation, Garante continued its investigation and has now identified potential data privacy violations without specifying details.
OpenAI Commitment and Defense Deadline
OpenAI insists its practices align with EU privacy laws, emphasizing efforts to minimize personal data in system training. The company expressed a commitment to collaborating with Garante constructively. Microsoft-backed has been given a 30-day deadline by Garante to present its defense arguments.
The investigation will consider insights from a European task force comprising national privacy watchdogs. Italy, as the first West European country to restrict ChatGPT, reflects the growing scrutiny from lawmakers and regulators on the AI tool’s rapid development.
The EU’s General Data Protection Regulation (GDPR), implemented in 2018, empowers authorities to impose fines of up to 4% of a company’s global turnover for rule violations. In December, EU lawmakers and governments took a step closer to regulating AI systems like ChatGPT, reaching provisional terms to govern this rapidly advancing technology.
